Welcome to BestDaysRx, LLC (“BestDaysRx,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the BestDaysRx website, mobile applications, patient portal, products, and services (collectively, the “Platform”).
By accessing or using the Platform, creating an account, completing a health assessment, purchasing products, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you should not use the Platform.
Eligibility
You represent and warrant that you:
- Are at least 18 years of age or the age of majority in your jurisdiction.
- Are legally able to enter into binding agreements.
- Reside in a state where BestDaysRx services are available.
- Will provide complete, accurate, and current information.
We reserve the right to refuse service or terminate accounts that do not meet these requirements.
About BestDaysRx
BestDaysRx provides access to provider-guided wellness services through licensed healthcare professionals and participating pharmacies.
BestDaysRx is not a medical practice, pharmacy, or health insurance provider. Medical care is provided solely by independent licensed healthcare providers. Prescription medications are dispensed only by licensed pharmacies.
BestDaysRx does not control or direct the independent medical judgment of healthcare providers.
Telehealth Services
Healthcare services are delivered through telehealth technologies and are subject to your separate Telehealth Consent.
Providers determine whether telehealth is appropriate for your medical needs and may recommend an in-person evaluation or decline treatment when medically appropriate.
Use of the Platform does not guarantee that you will receive a consultation, diagnosis, prescription, or treatment.
Medical Disclaimer
Information available through the Platform is provided for educational and informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your healthcare provider regarding medical concerns.
Do not ignore or delay seeking medical care because of information obtained through the Platform.
If you are experiencing a medical emergency, call 911 or seek emergency medical care immediately.
No Provider-Patient Relationship Until Accepted
Submitting information through the Platform does not automatically establish a provider-patient relationship.
A provider-patient relationship is formed only after a licensed healthcare provider reviews your information and agrees to provide care in accordance with applicable law.
Prescriptions
Healthcare providers exercise independent medical judgment when determining whether prescription treatment is appropriate.
Prescription approval is never guaranteed.
Providers may:
- Decline treatment
- Request additional medical information
- Require laboratory testing
- Recommend in-person evaluation
- Discontinue treatment when medically appropriate
Certain medications may not be available in every state.
Compounded Medications
Certain medications available through the Platform may be compounded medications prepared by licensed compounding pharmacies.
Compounded medications:
- Are customized for individual patient needs.
- Have not been reviewed or approved by the U.S. Food and Drug Administration (FDA).
- Are not evaluated by the FDA for safety, effectiveness, or quality prior to dispensing.
Your healthcare provider will determine whether a compounded medication is appropriate for your individual circumstances.
Orders and Payment
By placing an order, you authorize BestDaysRx and its payment processors to charge your selected payment method.
Prices are subject to change without notice.
Applicable taxes, shipping charges, and fees may apply.
Prescription medications generally cannot be returned once dispensed except where required by law.
Subscription Programs
Certain services may be offered through recurring subscription plans.
If you enroll in a subscription:
- You authorize recurring billing.
- Your subscription automatically renews until canceled.
- You may cancel according to the cancellation terms applicable to your plan.
- Cancellation does not entitle you to refunds for services already rendered or medications already dispensed unless required by law.
Shipping
Prescription medications are shipped by participating licensed pharmacies in accordance with applicable federal and state laws.
Delivery times are estimates only.
BestDaysRx is not responsible for shipping delays caused by weather, carrier delays, pharmacy processing times, or circumstances beyond our reasonable control.
User Accounts
You are responsible for maintaining the confidentiality of your account credentials.
You agree to:
- Maintain accurate account information.
- Keep your password secure.
- Notify us immediately of unauthorized account activity.
You are responsible for all activities occurring under your account.
Acceptable Use
You agree not to:
- Provide false information.
- Impersonate another individual.
- Attempt unauthorized access to the Platform.
- Upload malicious software.
- Interfere with website security.
- Use the Platform for unlawful purposes.
- Resell prescription medications or services.
Violation of these Terms may result in suspension or termination of your account.
Intellectual Property
All content available through the Platform, including text, graphics, logos, software, photographs, videos, trademarks, and branding, is owned by BestDaysRx or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works without prior written permission.
Third-Party Services
The Platform may integrate with or link to third-party websites, pharmacies, laboratories, payment processors, shipping carriers, or technology providers.
BestDaysRx is not responsible for the products, services, privacy practices, or content of third-party providers.
Privacy
Your use of the Platform is also governed by our Privacy Policy, HIPAA Notice of Privacy Practices where applicable, Telehealth Consent, and SMS/Text Messaging Consent.
Disclaimer of Warranties
The Platform and all services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.
BestDaysRx disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We do not guarantee uninterrupted, secure, or error-free operation of the Platform.
Limitation of Liability
To the fullest extent permitted by law, BestDaysRx and its affiliates, officers, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the Platform.
Our total liability for any claim shall not exceed the amount you paid to BestDaysRx for the services giving rise to the claim, unless otherwise required by applicable law.
Indemnification
You agree to indemnify and hold harmless BestDaysRx, its affiliates, officers, employees, contractors, healthcare providers, pharmacies, and service providers from any claims, damages, liabilities, costs, or expenses arising from:
- Your violation of these Terms.
- Your misuse of the Platform.
- Your violation of applicable law.
- Information you provide through the Platform.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which BestDaysRx is organized, without regard to conflict-of-law principles.
Dispute Resolution
Before filing any legal action, you agree to first contact BestDaysRx and make a good-faith effort to resolve the dispute informally.
To the extent permitted by law, disputes that cannot be resolved informally may be subject to binding arbitration or the exclusive jurisdiction of the appropriate courts, as described in any applicable arbitration agreement.
Changes to These Terms
We may modify these Terms from time to time.
Updated versions will be posted on this page with a revised Effective Date.
Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
